Under WA regulations, taxis and rideshares are exempt from the requirement to use a child car restraint. However, there is a requirement for taxi or rideshare drivers to ensure children are restrained as safely as possible.
Where there is no suitable, approved child car restraint available in a taxi or rideshare vehicle, children aged one to seven must occupy their own seat and be restrained in an adult seatbelt. They aren’t allowed to sit in the front seat.
Adult seatbelts used for children must be properly adjusted and securely fastened to the best extent possible given the height and weight of the child. The responsibility for ensuring seatbelts are properly used and the child is properly restrained, sits with the driver.
In both taxis and rideshare services, children under the age of one can be held on the lap of a passenger 16 years of age or over, according to the judgment of their caregiver. The best way to restrain a baby on your lap, if no other child car restraint is available, is to use a sling or baby carrier.
The safest option is always a child car restraint or booster, and it’s recommended you check whether one is available when the service is booked or bring your own.
