1. DEFINITIONS

‘Client’ – means the purchaser of the Equipment named in the Security Proposal Form.

‘Company’ – RAC Security Services (WA) Pty Ltd (ACN 096 235 200).

‘Equipment’ – goods and items of equipment detailed in the Security Proposal or as varied by the Client and agreed by the Company.

‘Installer’ – the person who is nominated by the Company to install the Equipment and who installs the Equipment for the Client.

‘RAC Group’ – means RAC and its related and subsidiary companies, including RAC Insurance Pty Ltd.

‘Security Proposal’ – means the document described as such to which these terms and conditions are attached and form part of.

2. VALIDITY

2.1 The Security Proposal remains valid for a period of thirty (30) days from the date of the Security Proposal. The Company reserves the right to revise the Security Proposal after the expiration date of 30 days.

2.2 The price shown in the Security Proposal is inclusive of workmanship, materials and Equipment and is inclusive of GST.

2.3 The Company reserves the right to revise the Security Proposal in the event new taxes, charges and fees are imposed by Government and/or Statutory Authorities, or price increases are imposed by suppliers of any of the materials, Equipment or labour.

2.4 The Company reserves the right to revise these terms and conditions provided that any revision that is detrimental to the Client will be notified to the Client, and the Client will have the right to terminate the Security Proposal without penalty.

2.5 Any cancellation by the Client or variations to the order (as detailed in the Security Proposal) requested by the Client must be notified by the Client to the Company in writing no less than 7 days prior to the agreed installation date.

2.6 If the Company agrees to accept any variations to the order requested by the Client the Client shall upon installation pay any extra Equipment and workmanship costs incurred as a result of the variations, which shall be charged to the Client at the Company’s standard prices and rates at
the date of installation.

2.7 Any additional Equipment ordered by the Client after acceptance of the Security Proposal will incur extra Equipment and workmanship cost. These extra costs will be included in the final purchase price.

3. PAYMENT

3.1 The Client shall pay a deposit of 30% of the price shown in the Security Proposal to the Company upon acceptance of the Security Proposal.

3.2 The Client shall on the day of completion of the work pay the balance of the purchase price referred to in the Security Proposal by one of the following payment methods: direct debit (balance on installation), direct debit (payment plan) or cheque. The Installer is duly authorised to
receive the payment by cheque on behalf of the Company.

 

4. INSTALLATION

4.1 In order to commence and complete the work, the Installer requires access to the Clients property between 0700 hours and 1630 hours Monday to Friday excluding public holidays and the Security Proposal is based on work being carried out during these hours.

4.2 The Client will provide the Company with twenty four (24) hours’ notice of a cancellation to the quoted installation time. Failure to provide notice will result in a cancellation fee.

4.3 In the event the Client does not provide access to the Client property at the quoted installation time, the Client will incur a no show fee.

4.4 Installation times quoted to the Client for commencement of installation are estimates only. The Company shall not be liable for any loss or damage howsoever arising due to any delay or failure by the Company to commence installation on the date or at the time quoted to the Client
in the Security Proposal.

4.5 Without limiting clause 4.4, the Company shall not be liable for any loss sustained by the Client through delay in delivery of the Equipment ordered where such delay shall have been caused or arise from events of force majeure including but not limited to strikes, shortage of labour or materials, riots, civil commotion, fire, flood, drought, loss, delay at sea, break-out of war.

4.6 To comply with legislative requirements, a home must be RCD protected before any new electrical work can be completed. If it is assessed that an RCD is required, additional costs for the RCD including installation and any associated labour will be added onto this Security Proposal, unless otherwise stated. This cost may vary depending on the complexity of the installation on the day. Should the home not be RCD protected, the Client must be aware that the power may be  interrupted during the installation, and would require other arrangements to be made for the power supply to the alarm system on completion.

5. WARRANTY

The Company guarantees the quality of the Equipment for the duration of the warranty periods set out in this clause subject to the following terms and conditions:

5.1 The Client must immediately notify the Company of any Equipment defects. The notification must also specify the date of installation.

5.2 The Company’s hours of work to rectify and/or replace defective Equipment under the warranty claim will be carried out between 0700 hours and 1630 hours Monday to Friday excluding public holidays.

5.3 The Company’s supplied Equipment and workmanship warranty details are listed below and, subject to clause 5.4, are under warranty from the date of installation:

5.3.1 Sensor and Pet Sensor – 24 months equipment warranty.

5.3.2 Control Panels and Code Pads – 36 months equipment warranty.

5.3.3 Door Contact, Window Contact, Smoke Detectors, Panic Buttons, Shock Sensors, Shatterpoints, Glass Break – 24 months equipment warranty.

5.3.4 Key Fobs and Kit Sirens, Battery and Plug Pack, GPRS Modems, Mode 3 and Central Splitter – 12 months equipment warranty.

5.3.5 Video/Audio Intercoms – 12 months equipment warranty

5.3.6 Installation workmanship – 12 months workmanship warranty

5.3.7 Any workmanship costs incurred outside of the 12 months workmanship warranty at the time the replacement and/or repairs are carried out will be paid by the Client at the hourly
labour rate current at that time for the Company.
5.3.8 The Equipment comes with guarantees that cannot be excluded under the Australian Consumer Law. These guarantees are in addition to other rights and remedies which
may be legally available.

5.4 This warranty does not extend to cover:

5.4.1 Any Equipment defects in relation to light globes and bulbs;

5.4.2 Any claims arising from failure to operate the Equipment in accordance to the instruction manual, fair wear and tear in the use of the Equipment or from misuse of the Equipment
by the Client or anyone on the Client’s property and/or any consequential loss howsoever arising from such claims;

5.4.3 The Equipment or any part thereof if it has been subject to service, alteration, repair or technical alteration by parties other than the Company or its authorised representatives; or

5.4.4 Equipment supplied or installed by parties other than the Company or its authorised representative.

5.5 The Client shall notify the Company of any proposed structural alteration to the premises following installation of the Equipment, which involves any alterations to the Equipment and its installation. Any alterations to the Equipment and its installation shall be carried out by the Company at the Client’s expense.

6. MAINTENANCE

6.1 The Company recommends to the Client that the Equipment installed should be inspected and/or serviced once per every two (2) years with not more than twenty five (25) months between visits (recommendations as per the Australian Standards (AS2201). The Company offers this service to the Client at the hourly rate current for the Company at the time the inspection and/or service are carried out.

6.2 Clauses 4.2 and 4.3 are applicable to services performed by the Company under this clause.

7. DISCLAIMER

7.1 The Equipment installed by the Company is only intended to reduce the risk of loss and damage to the property and/or injury to person(s) in or on the premises of the Customer to the extent that is reasonably practical by use of such Equipment. The Company gives no undertaking to the Client that any particular loss damage and/or injury can and will be prevented by the use of the Equipment and will not accept any liability whatsoever for loss damage or injury where
the Equipment has been installed.

7.2 The Customer Instructions and Acceptance Certificate forms part of the acceptance of these Conditions and is to be signed and completed by the Client following installation.
