Duty of disclosure

You have a duty to take reasonable care not to make a misrepresentation

Before you start, reinstate, extend, or vary a policy with the insurer, you have a duty to take reasonable care not to make a misrepresentation to them (“Your Duty”). 

When you ask for cover or request your cover to be altered, you must answer all the specific questions accurately, honestly and with reasonable care, to the best of your knowledge. This may mean, for example, that you should take reasonable steps to find out the answer to a question if you do not already know the answer before responding to the question. The insurer relies on the information that you provide to them to decide whether or not to insure you and, if so, on what terms (including the cost). Your Duty applies to everyone who will be insured under the policy and your answers to the questions on their behalf will be treated as their representations. 

Your Duty ends once the insurer agrees, in writing, to insure you. Whether or not you have taken reasonable care not to make a misrepresentation to the insurer will be determined with regard to all the relevant circumstances, including any of your particular characteristics or circumstances which the insurer ought to have been aware of. It may also include the type of insurance cover that you have asked for and who it is intended to be sold to, and whether or not someone was acting on your behalf when you asked for cover. 

If you do not take reasonable care not to make a misrepresentation, the insurer may be entitled to reduce or deny any claim you may make or cancel the policy altogether. If your failure to comply with Your Duty is fraudulent, the insurer may choose to avoid the contract from the beginning, which means treating it as though your policy never existed. If you are uncertain about whether or not a particular matter should be disclosed to the insurer, please contact them and they will try and assist you.

Who does the duty apply to?

Everyone who is insured under the policy must comply with the duty of disclosure.

What happens if you or they breach the duty?

If you or they do not comply with the duty of disclosure, we may cancel the policy or reduce the amount we pay if you make a claim. If fraud is involved, we may treat the policy as if it never existed and pay nothing.
